Results of Checks and Verification on Sex Offenders’ Employment restrictions
to be Published on Websites of Local Governments and Offices of Education
- Amendment to the Enforcement Decree of the Act on the Protection of Children and Youth Against Sex Offenses approved at the Cabinet Meeting on Tuesday, October 15.
The methods for public disclosure of the results of checks and verification on sex offenders’ employment restrictions at child and youth-related institutions, as well as improvements to the system of rewards for reporting sex offenses against children and youth, will be enhanced.
The Ministry of Gender Equality and Family(MOGEF) announced that the amendment to the Enforcement Decree of the Act on the Protection of Children and Youth against Sex Offenses (hereinafter referred to as the Youth Sexual Protection Enforcement Decree) was approved at the Cabinet Meeting on Tuesday, October 15.
The main content of the amended 'Youth Sexual Protection Enforcement Decree' mandates that local governments and offices of education check and verify at least once a year whether individuals sentenced with employment restrictions due to sex offenses are employed or operating within child and youth-related institutions, and that the results are to be published on the websites of the respective institutions within two months.
The disclosure of results of the checking and verification of employment restrictions for sex offenders is intended to inform local residents about the employment or operation of child and youth-related institutions by restricted individuals.
Currently, the results of these checks are compiled and published in bulk through MOGEF's Sex Offender Notice e-system in February of the following year. This improved approach is set to be implemented starting January 1, 2025.
Additionally, the criteria for paying rewards for reports of sex offenses against children and youth have been supplemented to allow payments not only in cases where the reported individual is charged or given a suspended prosecution but also for cases forwarded to the juvenile department of the court. Furthermore, the system will now reject reward payments for reports made with illegally gathered evidence.
Cho Yong-soo, Acting Director General of Women’s and Youth Rights Promotion Bureau, stated, "With the revision of this enforcement decree, the results of sex offender employment restriction checks will be more accessible to the local community.”
He added, "MOGEF will do its utmost to enhance the protection of children and youth from sex offenses."
